'Agreement' refers to the terms of use which governs the relationships between wherejackmetjill and its members.
'Communications' refers directly to any exchanges including but not limited to that consisting of e-mails by the members of WJMJ to other members of WJMJ be it in the form of messages or comments.
'Member' refers to any natural person, whose membership has been accepted by wherejackmetjill,
'Datespace' refers to that part of the website containing information about a member and pictures submitted by that member. The Datespace and its contents are the responsibility of the member. Wherejackmetjill may from time to time remove or delete content at its own discretion, if it deems the content inappropriate.
'Content' in this context is anything contained within the Datespace
'Subscriber' refers to those members who have paid the 1-month or 4 month subscription fee and thus have full-unlimited access to the sites service.
'Non subscriber' refers to those members yet to pay the subscription fee and thus is limited in the service they receive within the wherejackmetjill website.
'Service' refers to the level of service a member receives when a subscriber to wherejackmetjill contacts or is contacted by other members, non-subscribers would require to upgrade before being able to utilize this functions within the website.
'Comments' refer to statements posted using the comments feature available to subscribers only.
'friend' A friend is a person known to either the subscriber or member whose comments can be included on the Datespace within the confines of these Terms. This would refer to anyone's datespace on which you would want to leave a comment or alert other subscribers to a friend's Datespace if you believe they may be compatible.

3. You must be at least 18 years of age to use wherejackmetjill.com and become a member.
By becoming a member you automatically agree to these terms and conditions.
4. By using the website you warrant that you have the right, authority and capacity to enter into and be bound by these terms and conditions.
5. Wherejackmetjill is provided for the personal use of the individual and may not be used in connection with any commercial or business venture. You are prohibited from joining the site if you are doing so as a company or business.
6. The Site is free to join but certain functionality including communication with others members is only available to paying subscribers. It is the user's responsibility to provide the payment for the use of the website. Upon receiving payment of the relevant fee, the users herby agree to the immediate commencement of the full functionality.
7. Use of wherejackmetjill is purely voluntary and when operating within these terms and conditions you are allowed to remain a member for as long as you like.
8. Wherejackmetjill reserves the right to change the rates of subscription at any time; the same also applies to right to change user's options, renewal terms or membership options.
9. WJMJ reserves the right to terminate, deny or delete membership at any time without having to give reason or notice if at their discretion WJMJ feels that the terms and conditions have been breached or violated
10.The Membership fees only apply if you choose to upgrade from free membership to a subscribed member, by doing so you gain full access to the site and can communicate with other users should you choose to. It is wholly at the discretion of the individuals if they divulge personal information.
11. The amount payable will be wholly dependent on whether you choose the 1 month subscription or the 4 month subscription option; prices are as advertised and are inclusive of VAT.
12. WJMJ displays its prices on the website from time to time; these are inclusive of VAT and maybe subject to change at anytime.
13. Members will receive e-mail from wherejackmetjill when his/her membership has been accepted. They will also be alerted when their membership is nearly at an end. From time to time WJMJ reserves the right to contact users via their given e-mail address with regard to matters relating directly to the use of the site.
14. Payment to us can be made by Credit or debit card as outlined on the website.
15.You hereby agree not to post in your Datespace or transmit to another user without first becoming a subscriber contact details of any kind whether that be, but not limited to, phone numbers, street addresses, meeting places, links to other sites, URLS or e-mail addresses.
16. You hereby agree without exception not to post any images or content which WJMJ may, at its own discretion, deem inappropriate. This includes without exception material that is;
a) Sexually explicit in any way.
b) Exploits people under the age of 18 in a violent or sexual manner or attempts in anyway to solicit communication with people under that age.
c) Promotes conduct which could be deemed threatening, anti-social, obscene, defamatory, libelous or abusive.
d) Promotes the illegal or unauthorized copying of another persons copyrighted work including information on how to cheat manufacturer installed copyright protection within, but not limited to computer games or DVD's or provides links to pirated music files that make such music available without payment to the authorized distribution network.
e) Provides any guides, instructions or details, which solicit other users into the buying of or making of illegal weapons.
f) Provides details which act to infringe someone's privacy, providing or creating computers viruses contains or involves the transmission of junk-mail, spam, chain letters or mass mailing of any kind.
WJMJ reserves the right to take any action it deems necessary if in its sole discretion feels that the content of any Datespace violates these terms. This action may be but not limited to advising users via e-mail to change or remove content. Deleting content or images without prior notification, Deleting a personal datespace and removing it from the WJMJ without notification or providing any money back.
17. The comments posting feature is to be used for, but not limited to:
a) Posting comments on the Datespace of a friend informing other subscribers or non subscribers viewing the aforementioned Datespace of said friends good qualities and why someone should get to know them.
b) It can also be used to alert other subscribers or members to your friend's profile.
c) The comments feature could also be used to flirt with someone, for example you might post a comment on someone's Datespace informing him or her that you like their picture and invite an exchange of communication.
18. This feature is only available to subscribers. A comment however will be visible to all members unless the user on whose Datespace it is posted deletes it.
19. You hereby agree not to post any personal contact details as a comment on any other members Datespace with intention of soliciting external contact outside of the site without first subscribing to WJMJ
20. You agree not to post any material as a comment on any other user's Datespace that could be seen as content resembling anything described in section 16 a-f
21. You alone are responsible for managing the content of your comments section, any content posted on your comments page that you deem to be contrary to the terms and condition of WJMJ it is your responsibility to remove and you agree to report any abuse using the Report Abuse button at the foot of the Homepage
22. You can choose to delete any comments posted on your Datespace at any time.
23. WJMJ takes no responsibility for anything posted as a comment on any member or subscribers Datespace.
24. Whilst WJMJ reserves the right to remove content deemed offensive it does not guarantee that offensive material will be removed or deleted. Failure by wherejackmetjill to remove any such material does not waive our right to remove or delete offensive content in subsequent or similar cases.
25. You may not through either messages, comments or on your Datespace act to impersonate any other person or entity.
26. The opinion of its members/subscribers do not represent the views or opinions of either TinyPete Ltd or wherejackmetjill its sponsors, partners, advertisers or developers.
Warranties, Liabilities and Indemnity:
27. You may not post material belonging to any third party on the site without permission from them. This includes photos, images and text. Should you believe that any content is owned and managed by a third party you are requested to contact WJMJ with full details of the alleged copyright infringement including the member's username and contact details.
28. To file a copyright infringement notification with WJMJ we request that you send a written communication that includes substantially the following:
a) A signature, physical or electronic, of the person acting directly under the authorization of the owner of an exclusive right that is allegedly infringed, together with a list of such works claimed to have been infringed.
b) b) Identification of the material that is claimed to be infringed. Identification of the material or materials providing URLs in the body of an email is the best way to help us locate content quickly. _
c) A statement must be provided which would recognize the complainant as acting in good faith on behalf of the copyright holder or its representative. The statement must be accurate and would be representative in a court of law stating that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
29. You shall use this website for the sole purpose of online introduction.
30. You agree to adhere to UK, US, foreign and local laws applying to whichever country you are physically located in.

If in the event that WJMJ considers that as a user you are behaving in an illegal and /or an unauthorized fashion or abusing these terms and conditions by collecting members details for further use by sending unsolicited e-mails, by framing or linking to the website. WJMJ reserves the right to take any course of action it deems necessary which may include the termination of your account and subsequent removal of your datespace. Any illegal activities WJMJ reserves the right to instigate legal proceedings and takes no responsibility for the content that you choose to display on your datespace.
The content of WJMJ is predominantly made by its members and thus may contain facts, opinions, views, recommendations and advice, which are in no way endorsed by WJMJ or the Owners/Management TinyPeteLtd.
TinyPete Ltd will not disclose any personal details supplied by members that is not part of the Datespace including but not limited to your name, your user name, your e-mail address, without first obtaining your written consent.
With regard to the characters of "Jack and Jill" and any other characters that appear on this site you hereby understand that any perceived resemblance to real persons, living or dead is purely coincidental.
Intellectual property refers to copyright, trademarks, patents and design rights associated with the function and appearance of the website WJMJ which is owned by TinyPete Ltd.
You are expressly prohibited from reproducing, copying, editing, uploading, transmitting or in anyway incorporating into any other material any part or parts of this website.
You are expressly prohibited from changing in anyway by whatever means any registered or unregistered marks logos which are the property of TinyPeteLtd and are associated with wherejackmetjill.
You are prohibited from making any attempt to take unfair advantage of the reputation and goodwill of WJMJ or doing anything which could be considered as an infringement of any of the afore mentioned intellectual property rights without first obtaining written permission from the owner of the intellectual property.
WJMJ is committed to providing the maximum security possible of all personal details submitted at any stage of your experience with WJMJ, therein maintaining the utmost privacy and confidentiality of all information provided by its users.
WJMJ will be directly responsible for the management of your personal details and you consent to it being processed to the extent necessary to facilitate your use of this website in terms of it being an online introductory agency. You therefore give consent for WJMJ to process information directly relating to yourself and your preferences.

In the case of any action arising against a Subscriber resulting from their activities that have breached the Terms and Conditions of WJMJ the Subscriber hereby agrees to, hold harmless and defend WJMJ in any given claim or action against the Subscriber. Similarly if a Subscriber has any claim or right of action against any other party subject to the misuse of WJMJ the Subscriber hereby agrees to pursue any claim or action independently without seeking any demands from WJMJ and understand that any dispute would be settled without the involvement of the sites owners TinyPete Ltd unless at the discretion of the company it is deemed necessary to become involved.
If you become a Subscriber then and have not made use of any of the subscriber only functions you may cancel such subscription, and receive a refund of the relevant Fee, by sending a request by email to jack@wherejackmetjill.com within 7 days of the date on which the relevant Fee was paid. Please note that where the Subscriber has made any Use of the Subscriber only functions, no right of cancellation shall apply. For the purpose of this clause Use of the Subscriber only functions shall include activating and/or accessing any Subscriber only functions, communicating with other Users, reading messages or commenting on other users page.
These Terms will remain in full force and effect while you are a User of the Website.
You may cease to be a User at any time simply go to your account settings and select Delete datespace
